Terms & Conditions

AJS Operations SMS Program · Effective May 27, 2026 · Last updated May 27, 2026

These Terms & Conditions (the “Terms”) govern your participation in the SMS scheduling and dispatch program (the “SMS Program”) operated by American Janitorial Services Inc., a California corporation operating under the trade name “AJS Operations” (“AJS,” “we,” “us,” or “our”). Please read these Terms carefully before participating in the SMS Program. Your enrollment in the SMS Program and your continued receipt of SMS messages from AJS constitute your acceptance of these Terms.

1. Acceptance of Terms

By enrolling in the SMS Program, providing your mobile telephone number to AJS for dispatch purposes, or continuing to receive SMS messages from AJS, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not participate in the SMS Program and you should request removal from our messaging list as described in Section 9.

2. Program Name & Description

The program is identified as the “AJS Operations Scheduling” SMS Program. Under the SMS Program, AJS sends short message service (SMS) text messages to authorized contractors and employees regarding work assignments, scheduling, dispatch updates, and operational notices. Messages typically include the assignment location, service type, scheduled date and time, and other operational details reasonably necessary to perform the assignment.

3. Eligibility

The SMS Program is available only to authorized AJS contractors and employees who are: (a) at least eighteen (18) years of age; (b) legally authorized to perform work for AJS in the United States; (c) located within the United States; and (d) the authorized user of the mobile telephone number provided to AJS. The SMS Program is not available to members of the general public and is not open to public opt-in. AJS reserves the right to verify eligibility and to refuse or terminate enrollment at its sole discretion.

4. Enrollment & Consent

Enrollment in the SMS Program occurs in person at the time of hiring or engagement, after the contractor or employee provides verbal consent during in-person onboarding, which AJS records in its internal records. By providing your mobile telephone number to AJS, you represent and warrant that you are the authorized user of that number, that you consent to receive SMS messages from AJS at that number, and that you will promptly notify AJS in writing if your number changes or if you no longer wish to receive messages. You may withdraw your consent at any time as described in Section 9.

5. Message Frequency

Message frequency varies based on scheduled work volume. An individual contractor or employee typically receives between one (1) and ten (10) SMS messages per week. AJS makes no representation or guarantee as to any specific message frequency.

6. Message & Data Rates

Message and data rates may apply to all SMS messages sent or received under the SMS Program, in accordance with your mobile carrier's plan. AJS is not responsible for any charges imposed by your mobile carrier in connection with your participation. Please consult your mobile carrier for details regarding your messaging plan.

7. Carriers

The SMS Program is available on most major United States wireless carriers. Carriers are not liable for delayed or undelivered messages. AJS is not responsible for delays in or failures of message delivery caused by your carrier, your device, network conditions, or any other circumstance beyond AJS's reasonable control.

8. User Responsibilities

As a participant in the SMS Program, you agree to: (a) keep your mobile telephone number current and notify AJS in writing of any change; (b) not share your AJS account, dispatch information, or message content with any unauthorized person; (c) treat the content of SMS messages as confidential business information of AJS and its customers; (d) comply with all applicable federal, state, and local laws in connection with your participation; and (e) not use the SMS Program for any unlawful, harassing, abusive, or otherwise improper purpose.

9. Opt-Out (STOP)

You may cancel the SMS service at any time by replying STOP to any AJS SMS message. After you send STOP, AJS will send a one-time confirmation message acknowledging that you have been unsubscribed, after which you will no longer receive SMS messages from AJS under the SMS Program. You may also opt out by contacting the business directly at info@ajsoperations.us or 510-778-3104 and requesting removal. If you would like to opt back in at a later time, please contact AJS directly to be re-enrolled.

10. Help (HELP)

If you are experiencing issues with the SMS Program or need assistance, you may reply HELP to any AJS SMS message, and AJS will respond with the business contact information. You may also contact AJS directly at 510-778-3104 or info@ajsoperations.us for assistance.

11. Service Availability

The SMS Program is provided on an “as available” basis. AJS does not guarantee that the SMS Program will be available without interruption, that messages will be delivered in any specific timeframe, or that the SMS Program will be free from errors, delays, or technical issues. AJS may suspend, modify, or discontinue the SMS Program, in whole or in part, at any time and without prior notice.

12. Modifications to the Program & These Terms

AJS reserves the right to modify, suspend, or discontinue the SMS Program at any time, with or without notice. AJS may also revise these Terms from time to time by posting an updated version on this page and updating the “Effective” and “Last updated” dates. Material changes will be communicated to participants by direct notice (SMS or email) where reasonably practicable. Your continued participation in the SMS Program following the posting of revised Terms constitutes your acceptance of the changes.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SMS PROGRAM AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED IN CONNECTION WITH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. AJS DOES NOT WARRANT THAT THE SMS PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AJS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE SMS PROGRAM OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT AJS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL EVENTS, AJS'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SMS PROGRAM WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US $100.00).

15. Indemnification

You agree to indemnify, defend, and hold harmless AJS, its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your violation of these Terms; (b) your misuse of the SMS Program; (c) your violation of any applicable law or the rights of any third party; or (d) any content or communications you transmit through the SMS Program.

16. Governing Law & Jurisdiction

These Terms and any dispute arising out of or relating to them or to the SMS Program are governed by, and construed in accordance with, the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 17, you agree that any action or proceeding arising out of or relating to these Terms or the SMS Program will be brought exclusively in the state or federal courts located in Alameda County, California, and you irrevocably consent to the personal jurisdiction and venue of those courts.

17. Dispute Resolution

Before initiating any legal action, you and AJS agree to attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the SMS Program through informal negotiation. To initiate informal negotiation, you must send a written notice describing the dispute to AJS at the contact information in Section 21. If the dispute is not resolved within thirty (30) days of receipt of the notice, either party may pursue the matter in court in accordance with Section 16.

18. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any written onboarding documentation between you and AJS, constitute the entire agreement between you and AJS regarding the SMS Program and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral, relating to the subject matter of these Terms. No waiver of any provision of these Terms will be effective unless made in writing by AJS.

20. Privacy Policy

Your use of the SMS Program is also governed by our Privacy Policy, which describes the categories of information we collect, how we use and protect that information, and the rights you have with respect to your personal information.
